Terms of use

These terms apply when you use Challenge That Debt, including the free check, the free tools and guides, and any letters you buy. We have written them in plain English. The most important point comes first: we provide information and self-help documents, not legal advice.

Which state do you live in?

Time limits on debt and some collection rules depend on your state.

1. Who we are

Challenge That Debt is operated by Smart Choice Claims Limited, a company registered in England and Wales (company number 13062399), whose registered office is at Wellfield House, Park House Lane, Keynsham, Bristol, BS31 2SG, United Kingdom. In these terms, "we", "us" and "our" mean Smart Choice Claims Limited, and "you" means the person using the site.

Challenge That Debt is not a law firm, and nothing on this site is legal advice. Our guides, state pages, collector pages, free tools and letters give general information and self-help documents prepared from the answers you give. They are not advice about your particular situation.

Using the site, buying a letter, or contacting us does not create an attorney-client relationship with us or with anyone else. Our letter templates and state pages have been reviewed by a licensed US attorney, but that review is of our documents, not of your circumstances, and it does not make that attorney your lawyer.

Laws change and every situation is different. If you have been sued, if a lot of money is at stake, or if you are unsure what to do, please talk to a licensed attorney in your state or your local legal aid office.

3. What we provide

Free information and tools. Our guides, state and collector pages, the free check and the free tools are provided free of charge, as general information.

Paid letters. If you buy a letter, we provide self-help documents built from your answers: a dispute and validation letter addressed to the debt collector, and the follow-up letters described at the time of purchase, as files you can download.

What we do not do. We do not send letters for you, contact debt collectors, creditors, courts or credit bureaus on your behalf, negotiate for you, or represent you in any way. You decide whether, when and how to use the documents.

4. We do not promise any outcome

We cannot promise what a debt collector, creditor, court or credit bureau will do. A letter may lead a collector to stop collecting, correct an error or prove the debt, or it may not.

We do not offer to improve, repair or remove anything from your credit report or credit score, and nothing we sell is a credit repair service. Our free guides explain what consumers can do themselves.

5. Your responsibilities

When you use the free check or buy a letter, you agree to:

  • give accurate, complete answers, because the letter is only as accurate as the answers it is built from;
  • read the letter carefully before sending it, and change anything that is not right;
  • keep track of your own deadlines, including any deadline in a collector's notice or in court papers; our tools help you calculate dates, but you are responsible for meeting them;
  • use the letters only for a debt you are personally dealing with, or one you have the legal authority to deal with for someone else; and
  • not use the site to deceive anyone or for any unlawful purpose.

6. Prices and payment

Prices are shown in US dollars before you pay, and each purchase is a one-off payment, not a subscription. Payments are processed securely by Stripe; we never see or store your full card details. Sales tax is added where it applies, and is shown before you pay.

Lower price for military, veterans, seniors and people with disabilities. If you are serving in or a veteran of the US armed forces, are 65 or older, or have a disability, you can choose our lower price at checkout. It works on trust: you confirm you qualify by ticking a box, and we do not ask for proof. Please choose it only if it applies to you.

7. Delivery and access

Your letters are available straight away after payment, in your browser, as PDF and editable Word files. We also email you a link that brings you back to your letters for 30 days from purchase, on any device.

We do not keep copies of your letters or the answers you gave (see our privacy policy). When you use the link, you confirm a few answers again and your letters are rebuilt on your device. Please download and keep your files.

8. Refunds

If a letter turns out not to fit your situation, or you are unhappy with it for any reason, contact us within 14 days of your purchase and we will refund you in full. If you were charged more than once, or a technical problem stopped you getting your letters, we will refund you whenever you tell us.

Refunds go back to the card you paid with. This does not affect any rights you have under the law where you live.

9. Information on the site

We work hard to keep our information accurate and we cite our sources, so you can check them. But laws, regulations and company details change, and we cannot guarantee that every page is complete or up to date at the moment you read it. Our changelog lists the corrections and updates we make.

Links to other websites are for your convenience; we are not responsible for their content.

10. Using our content

You may use the letters you buy for your own matter, including copying and editing them. The rest of the site, including our guides, templates and design, belongs to us, and you may not copy it for commercial use without our permission. Quoting short passages with a link back is fine.

You may not misuse the site, for example by trying to break its security, overload it, or extract its content automatically in bulk.

11. Our responsibility to you

We are responsible for providing the service with reasonable care and skill. If we fail to do so, our total responsibility to you for any purchase is limited to the amount you paid for it.

We are not responsible for losses that come from how you choose to use the information or documents, from missed deadlines, or from what a collector, creditor, court or credit bureau decides.

Nothing in these terms limits any liability that cannot be limited by law, or removes any rights you have as a consumer under the laws that apply to you.

12. If you have a complaint

Please contact us first; most problems can be fixed quickly. These terms are governed by the laws of England and Wales. If you are a consumer living in the United States, you also keep the protections of the consumer laws of your state, and you may bring a claim in the courts where you live.

13. Changes to these terms

We may update these terms from time to time, and will change the date at the top of this page when we do. The terms in force when you made a purchase apply to that purchase.

Common questions

Is this legal advice?

No. We provide general information and self-help documents. We are not a law firm, and using the site does not create an attorney-client relationship.

Do you send the letter for me?

No. You download the letter and send it yourself, usually by certified mail.

Can I get a refund?

Yes. Contact us within 14 days of purchase for a full refund if the letter does not fit your situation or you are unhappy with it.

Will this fix my credit?

We do not offer credit repair or promise any change to your credit report or score.
